Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) has been concluded between the Seller, whose information is provided below, and the Buyer who makes a purchase electronically through the www.pensionacademia.com website, in accordance with the applicable consumer protection and distance selling regulations.

Buyer: The user who purchases online training videos through www.pensionacademia.com.

2. Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of online training videos ordered electronically by the Buyer through the Seller's website, www.pensionacademia.com.

3. Products and Services

The services purchased by the Buyer consist of online training videos provided digitally. The Buyer has the right to access the purchased videos for personal use only. Reproduction, copying, sharing with third parties, or commercial use of the videos is strictly prohibited.

4. Order and Payment Terms

• The Buyer adds the selected training videos to the shopping cart electronically through the website.
• Payment is processed through the secure payment infrastructure contracted by the Seller.
• Credit card or debit card information is not stored by the Seller under any circumstances; it is processed solely by the relevant payment service provider.
• Once the payment is confirmed, the Buyer is automatically granted access to the training videos.

5. Delivery Method

Since the product sold is digital content, no physical delivery is involved. Access to the training videos is provided to the Buyer online through the Buyer's user account.

6. Right of Withdrawal and No-Refund Policy

All sales are final and non-refundable. The trainings are digital content that is made available immediately after payment. In accordance with applicable consumer protection legislation on digital content supplied electronically, the Buyer expressly agrees, before completing the payment, that performance begins immediately and acknowledges that the right of withdrawal is therefore lost. No refund, cancellation or exchange is possible after the order has been paid — this applies to individual purchases and to corporate licence packages, including unused seats and seats whose access has been cancelled by the licence owner.

7. Buyer's Obligations

• The Buyer shall access the purchased training videos for personal use only.
• The Buyer is responsible for the security of their user account and password.
• The Buyer may not reproduce, share, sell, or use the videos for commercial purposes.
• The intellectual property rights of the content provided by the Seller are protected.

8. Seller's Obligations

• The Seller is obliged to provide the service paid for by the Buyer completely and as promised.
• The Seller shall provide the necessary technical support to resolve system-related issues as soon as possible.
• The Seller shall protect the confidentiality of the personal data provided by the Buyer and process such data in accordance with the GDPR and applicable data protection legislation.

9. Intellectual and Industrial Property Rights

All intellectual and industrial property rights relating to the content, training videos, graphics, texts, and images available on the website belong to Pensión Research & Consulting. The Buyer acknowledges and agrees that such content may not be used, reproduced, or distributed without authorization.

10. Disclaimer

The Buyer is responsible for providing the device, software, and internet connection required to access the training videos. The Seller cannot be held responsible for access problems arising from the Buyer's technical infrastructure.

11. Dispute Resolution

Any disputes arising from this Agreement shall be resolved in accordance with the applicable consumer protection legislation and other relevant laws. The Buyer may apply to the competent consumer protection authorities, alternative dispute resolution bodies, or courts as provided under applicable law. Where legally permissible, the courts and enforcement offices of Istanbul (Anatolian Side), Türkiye shall have jurisdiction.

12. Entry into Force

By placing an order through www.pensionacademia.com, the Buyer declares that they have read, understood, and accepted all terms and conditions of this Agreement. This Agreement enters into force upon its electronic approval.
